Agreement to Terms (EULA)

These Terms & Conditions ("Terms") govern your access to and use of the Amassable mobile application, this website, and related services (collectively, the "Services"). Amassable is operated by 712 West LLC ("we," "us," or "our"). For app marketplaces that require an end user license agreement, these Terms are your EULA for the Amassable app and related software we provide.

You must agree to these Terms before using the Services. By creating an account, tapping accept where prompted, downloading or installing the app, or otherwise accessing or using the Services, you acknowledge that you have read and agree to be bound by these Terms. If you do not agree, do not use the Services.

We maintain zero tolerance for objectionable content and for abusive, harassing, discriminatory, threatening, hateful, violent, sexually exploitative, or otherwise harmful users or conduct. Such content and behavior are prohibited. Enforcement—including removal of offensive content, warnings, and account bans for repeated offenses—is described below.

Our Privacy Policy describes how we collect and use personal information and is incorporated by reference.

Eligibility

You must be at least 13 years old to use the Services. If you are between 13 and the age of majority where you live, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. You may not use the Services where prohibited by law.

Accounts and Security

You may need to create an account to use certain features. You agree to provide accurate information and to keep your credentials confidential. You are responsible for all activity under your account. Notify us promptly if you suspect unauthorized access.

The Services

Amassable provides tools to catalog, organize, and share collections and to connect with other users. Features may change over time. We may modify, suspend, or discontinue any part of the Services with or without notice.

Acceptable Use

You agree not to:

• Violate any applicable law or regulation
• Harass, abuse, threaten, or discriminate against others
• Upload or share content you do not have the right to use, or that infringes intellectual property or privacy rights
• Upload malware, attempt unauthorized access, or interfere with the security or operation of the Services
• Scrape, data-mine, or use automated means to access the Services in a way that burdens our systems without our prior written consent
• Misrepresent your identity or affiliation, or use the Services for fraudulent purposes
• Share content that sexualizes, exploits, or endangers minors, or that otherwise violates our community standards or Privacy Policy

We may investigate violations and cooperate with law enforcement. We may remove content, issue warnings, suspend or ban accounts (including after repeated violations), and take other appropriate action at our sole discretion, as described in the Objectionable Content, Filtering, and Reports section below.

Objectionable Content, Filtering, and Reports

We use a combination of measures to limit objectionable content, including technical and procedural safeguards (such as automated screening or filtering where available), account and content review, community reporting tools in the Services, and other moderation practices we may add or change over time. These measures supplement but do not replace your obligation to comply with these Terms; they may not catch all objectionable material.

If you see objectionable content or abusive behavior, you may report it using the reporting features in the app or website, or by contacting us through the options described in the Contact section below.

When we receive a report of objectionable or offensive content or abusive conduct, we will review it promptly. If we determine that User Content violates these Terms, we will remove that content within twenty-four (24) hours of our receipt of the report. We will also send a warning to the user who posted or was responsible for that content, notifying them of the violation. Users who commit multiple offenses may be banned from the platform (permanent or long-term suspension of their account), in addition to removal of the offending content.

Notwithstanding the foregoing, we may impose an immediate ban without a prior warning when, in our sole judgment on a case-by-case basis, a violation is egregious—for example, illegal content, credible threats of violence, or sexual exploitation or endangerment of minors.

User Content

You retain ownership of content you submit to the Services ("User Content"), such as collection items, images, descriptions, and profile information. You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify, display, distribute, and otherwise use User Content solely to operate, improve, promote, and provide the Services, including as you choose to share it with other users (for example, public collections or community features).

You represent that you have all rights necessary to grant this license and that your User Content complies with these Terms. You are solely responsible for your User Content and the consequences of posting or sharing it.

Subscriptions and Purchases

Paid features or subscriptions, if offered, may be processed by third parties such as Apple App Store, Google Play, or our payment and subscription partners. Purchases are subject to those platforms' terms and billing policies. Fees, renewal, cancellation, and refunds are handled according to the applicable store or provider rules unless we expressly state otherwise in the Services.

Intellectual Property

The Services, including software, branding, logos, and documentation, are owned by us or our licensors and are protected by intellectual property laws. Except for the limited rights expressly granted in these Terms, we reserve all rights. You may not use our name or marks without prior written permission except as allowed by normal use of the Services.

Third-Party Services

The Services may integrate with or link to third-party services. We do not control and are not responsible for third-party content, policies, or practices. Your use of third-party services is at your own risk and subject to their terms.

Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. YOU USE THE SERVICES AT YOUR OWN RISK.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE OR OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES IS LIMITED TO THE GREATER OF ONE HUNDRED U.S. DOLLARS (USD $100) OR THE AMOUNT YOU PAID US FOR THE SERVICES IN THE TWELVE MONTHS BEFORE THE CLAIM (IF ANY). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY WILL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

Indemnification

You will defend, indemnify, and hold harmless 712 West LLC and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your User Content, your use of the Services, or your violation of these Terms or applicable law.

Termination

You may stop using the Services at any time. We may suspend or terminate your access if you violate these Terms or if we need to do so for legal, security, or operational reasons. Provisions that by their nature should survive termination (including ownership, licenses granted to us for User Content as needed to wind down the Services, disclaimers, limitations of liability, indemnity, and governing law) will survive.

Changes to These Terms

We may update these Terms from time to time. We will post the revised Terms on this page and update the "Last updated" date. Material changes may be communicated through the Services or by other reasonable means. Your continued use after changes become effective constitutes acceptance of the revised Terms.

Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law principles, except where mandatory consumer protection laws of your jurisdiction require otherwise.

General

These Terms constitute the entire agreement between you and us regarding the Services and supersede any prior agreements on that subject. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver of our right to do so later.
